Van Veen Advocaten (VVA) is a partnership comprising various practising firms and natural persons, with the aim of providing legal representative services in the widest sense.
Whenever necessary VVA, in the course of providing these services, calls on other persons needed to perform assignments from its clients.
VVA sees all assignments it receives from clients as belonging to the firm as a whole, even when the assignment is implicitly of explicitly given to one person. This does not include the reach of article 7:404 Dutch Civil Code, which provides for the latter case, and the reach of article 7:407 paragraph 2, which establishes several liability in cases where the assignment is given to two or more persons.
These Standard Terms apply to all assignments given to VVA, including supplementary and follow-up assignments.
Should a situation arise during the handling of an assignment that involves liability, this liability shall be limited to the amount or amounts covered by the liability insurance taken out by VVA. This includes any excesses VVA may be responsible for pertaining to this insurance. Negligence is included in the definition of a situation as mentioned in the previous sentence.
Should a person or means suffer damages resulting from an assignment handled by VVA, or in any other way, and VVA be liable for these damages, this liability shall be limited to the amount or amounts covered by the general liability insurance (AVB) taken out by VVA. This includes any excesses VVA may be responsible for pertaining to this insurance.
Persons called on in the course of handling of an assignment may want to limit their liability. VVA assumes, and if necessary stipulates here, that all the assignments it receives from clients include the competence to accept such a limitation of liability on behalf of its clients.
In the event that handling an assignment of a client calls for involving a person outside of the Netherlands who has no ties to VVA, to handle something within the scope of the assignment, VVA shall not be liable for any mistakes this person may inadvertently make.
The relationship between VVA and its clients is covered by Dutch Law. The Dutch courts are solely competent to handle any disputes that may arise between VVA and one of its clients.
The Standard Terms apply not only to VVA, but also to any persons VVA calls on to aid in handling an assignment from one of its clients. The same is true for previous employees, including any successors, in the event these are held liable after leaving VVA.
